Gen 3: Will the JDM swapped H6 pass emissions in CO?

I have a 2005 Subaru Outback 3.0 aaaand I am fairly certain the head gaskets are going. I have a spare junkyard engine and I was considering rebuilding one of my engines, but then I saw a JDM EZ30 goes for a price similar to the cost of a rebuild. Both of my engines have 220k miles on them, so I think it would make more sense to go the JDM route and sell both of my engines, instead of trying to rebuild one.

My question is, will the JDM engine pass emissions in Colorado? My friend was doing research into an EJ25 JDM swap and determined those would not pass emissions, is that the same case for the EZ30?
